These terms are the agreement between you and us about using Aptly. They are written in plain language on purpose — an agreement nobody can read is an agreement nobody consented to.
1. Who this is between
Aptly (“we”, “us”) is operated by:
STEFAN JANDRIĆ PR CODEWAVE — a sole trader registered in the Republic of Serbia
Sentandrejski put 51, 21000 Novi Sad, Serbia
Tax ID (PIB) 114607697 · Company number (MB) 67711114
booking@aptly.sh
“You” means the business that opened the account, and anybody you invite into it.
By opening an account you accept these terms. If you are accepting them on behalf of a company, you are confirming you are allowed to.
2. What we provide
A booking system: a public page where your clients book, a calendar for your team, a client book, reminders by email and — on paid plans — by text message, and reports on your own bookings. What each plan includes is on our pricing page, and the same numbers are enforced inside the product.
We improve the product continuously. We will not remove a feature you are paying for without telling you first.
3. Your account
- Keep your password to yourself, and turn on two-factor authentication. It is free on every plan.
- You are responsible for what the people you invite do inside your account.
- Tell us promptly if you think somebody else has got in.
- One account is for one business. A chain is one account with several locations — that is what the plans are built for — but two unrelated businesses sharing a login is not.
4. Your clients' data belongs to you
Your client list, your appointments, your notes — yours. We hold them to run the service and for nothing else. We do not sell them, we do not market to your clients, and we do not use one business's data to help another.
You are the controller of your clients' personal data and we are your processor. That means you decide what you collect and why; we follow your instructions. It also means the consent you collect has to be real: you must not upload numbers or addresses you have no permission to message, and you must honour it when somebody asks you to stop.
If you leave, ask and we will export your clients and your bookings in a format you can open.
5. Messages
- Reminders and confirmations are transactional messages about an appointment somebody made. That is what the product is for.
- Aptly is not a bulk marketing tool. Do not use it to send advertising to people who did not agree to receive it. Doing so puts our sender routes at risk for every other business on the platform, and we will suspend an account that does it.
- Text messages are billed per message. One message is one credit; a message too long to fit in one text counts as two, and the product tells you so while you are writing it.
- Carriers and phone networks are not perfect. We will make every reasonable effort to deliver a message, but we cannot guarantee a specific one arrives.
6. Paying and refunds
- Payments are processed by Creem, our merchant of record. Creem sells to you, issues your invoice and handles VAT. We never see your card.
- Plans are billed in advance for the period you chose. Prices are shown before you pay.
- Text messages come out of your plan's monthly allowance, and out of any credit packs you have bought. When both are empty we do not send texts you have not paid for and we do not invoice you for them — the reminder goes out by email instead, and texts resume when you buy a pack.
- You can change plan or cancel at any time. Cancelling stops the next renewal; the plan runs to the end of the period you already paid for.
- If we change a price, we will give you at least 30 days' notice and it will not apply to a period you have already paid for.
Refunds
The line we draw is simple: what you have not used, we give back; what has already been delivered, we cannot. A text message is paid to a phone carrier the moment it is delivered, and that money is gone from us whether or not you stay.
- A subscription period you have not used. If you were charged for a period in which nothing happened — no appointments booked, no reminders sent — write to us within 14 days of the charge and we refund it in full.
- A subscription period you have used. Not refunded. Cancel whenever you like and the plan simply runs to the end of what you already paid for; nothing renews after that.
- An untouched SMS credit pack. Refunded in full within 14 days of purchase, as long as not one message has gone out of it.
- A credit pack you have started sending from. Not refunded, for the reason above — the carrier has already been paid for those messages. Credits never expire, so whatever is left stays yours to use later, on any plan, including the free one.
- Email reminders are unlimited on every plan and are never billed separately, so there is nothing to refund on them. When your texts run out, reminders keep going by email at no cost to you.
- Anything that went wrong on our side — a double charge, a plan you did not order, a failure that took the service away from you — we refund, and we would rather you told us than disputed it with your bank.
Refunds are issued by Creem, the seller on your invoice, and go back to the card you paid with; allow a few working days for your bank. Ask us and we will start it. Creem's own refund terms apply alongside these ones.
7. The free plan
The free plan is free, permanently, within the limits published on the pricing page. It is not a trial and nothing switches off after two weeks. We may change what the free plan includes for new accounts; if we change it for yours, you will hear from us first.
8. What you must not do
- Break the law with it, or help somebody else to.
- Send unsolicited marketing through it.
- Try to reach data belonging to another business on the platform.
- Probe, scan or load-test the service without written permission. If you find a security problem, tell us — we would rather hear it from you.
- Resell the service as your own without an agreement with us.
9. Uptime, and honesty about it
We work hard to keep Aptly available and we monitor it continuously, but no online service is up every second of every year. We do not offer a contractual uptime guarantee on standard plans. If you need one, that is an Enterprise conversation and we are happy to have it.
Planned maintenance that would interrupt bookings is announced in advance and scheduled outside business hours wherever possible.
10. Suspension and ending it
- You can close your account whenever you like.
- We may suspend an account that is not paid for, or that is being used in a way that breaks section 8 or endangers other customers. Except where the law requires immediate action, we will warn you first and give you a chance to fix it.
- After an account closes we keep the data for 30 days so it can be recovered if closing it was a mistake, then delete it. Backups age out within 90 days.
11. Liability
Aptly is provided as it is. To the extent the law allows, our total liability to you for any claim is limited to what you paid us in the twelve months before the claim, and we are not liable for lost profit, lost bookings or indirect loss.
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, your statutory rights are unaffected.
12. Changes to these terms
We will give at least 30 days' notice by email before a material change takes effect. Continuing to use Aptly after that means you accept the new version. If you do not, you can cancel and we will refund the unused part of the period you paid for.
13. Law and disputes
These terms are governed by the law of the Republic of Serbia, and its courts have jurisdiction. If you are a consumer resident elsewhere, this does not take away the protection of the mandatory law of the country you live in. Before either of us goes to court, we agree to try to sort it out by writing to each other first.
14. Which version counts
These terms are published in several languages for convenience. If a translation and the English version disagree, the English version is the one that applies.
